1. Who we are

These terms govern your purchase and use of the EskoAI software and installation service offered at eskoai.eu. "EskoAI", "we", "us" and "our" refer to the operator of this website, trading as EskoAI, operating from the United Kingdom. "You" means the person or organisation purchasing a license. By placing an order you agree to these terms.

2. What you are buying

An EskoAI engagement consists of two elements:

• Installation service (one-time, £1,000). Our team prepares your environment, provisions the local model, configures the application on your Mac, and curates your first memory bank with you.
• Software license (£800 per calendar month). A term license to use the EskoAI application on the installed machine for the number of months you select at checkout, including software refinements and priority support during the term.

All prices are in pounds sterling (GBP). Prices are exclusive of any applicable VAT or sales tax, which will be stated before payment where it applies.

3. Term discount

Terms of two months or more earn a discount on the license value of the term: 2% at two months, rising by one percentage point per additional month, to a maximum of 10% for terms of ten months or longer. The discount never applies to the installation fee. The exact discount and total are displayed before you place your order.

4. Ordering, payment, and delivery

• Submitting the order form reserves your order and generates an order reference. No payment is taken on this website at the point of reservation.
• We will contact you within one business day to confirm your order, take payment through our payment processor, and schedule installation. We do not see or store your card details; payment is handled by the payment processor.
• Delivery is performed by installation: the software is installed and activated on your hardware by our team, and your unique license key is issued to you in writing on completion of installation. Installation is normally completed within 14 days of payment unless we agree a later date with you.
• The license term begins on the date your license key is issued.

5. Cancellation and refunds

• Before installation: you may cancel for any reason and receive a full refund of everything you have paid, including the installation fee.
• Within 14 days after installation: you may cancel and receive a full refund of the license fees. The installation fee is retained, as that service has been performed with your agreement.
• After 14 days: you may cancel the remainder of your term at any time. We will refund the value of the remaining complete unused months, recalculated without the term discount that the shortened term would not have earned.
• Refunds are issued to the original payment method within 10 business days of the cancellation being agreed. To cancel, email enquiries@eskoai.eu with your order reference.
• Nothing in this section limits your statutory rights, including rights under the Consumer Rights Act 2015 where you deal with us as a consumer.

6. Renewals

Licenses do not renew automatically and we do not charge your payment method on a recurring basis without your instruction. Before your term ends we will contact you to arrange renewal if you wish to continue.

7. License grant and restrictions

Subject to payment, we grant you a non-exclusive, non-transferable license to use the EskoAI application on the machine on which it was installed, for the duration of your term. You may not:

• copy, resell, rent, sublicense, or redistribute the software or your license key;
• reverse engineer, decompile, or modify the software except where permitted by law;
• use the software for unlawful purposes, or to attack, access, or interfere with systems you do not own or lack authorisation to test.

The software, its design, and all associated intellectual property remain our property. Everything you teach your installation — your documents, your memory bank, your skills dataset — remains yours.

8. Requirements and support

EskoAI requires macOS 11 or later; Apple Silicon is recommended. During your term we provide priority support by email and supply software refinements and improvements. Support covers the EskoAI application; it does not cover general maintenance of your hardware or operating system.

9. Privacy of the product

The EskoAI application runs locally on your machine. Your conversations, documents, and memory bank are stored on your hardware and are not transmitted to us. Optional research features access the internet only when you deliberately invoke them. Details of the personal data we process when you order are in our Privacy Policy.

10. Warranties and liability

We warrant that the software will materially perform as described on this website during your term and that installation will be carried out with reasonable skill and care. Except for that warranty, the software is provided "as is". Output of a local AI model is generated content and should be reviewed before you rely on it for business, legal, or financial decisions.

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded by law. Otherwise, our total liability arising out of an engagement is limited to the amount you paid us in the twelve months before the claim arose, and we are not liable for indirect or consequential loss, loss of profit, or loss of data caused by factors outside the software.

11. Termination for breach

We may suspend or terminate your license if you materially breach these terms and do not remedy the breach within 14 days of written notice. You may terminate as described in section 5.

12. General

These terms are the entire agreement between us concerning your order. If any provision is found unenforceable, the remainder stays in effect. We may update these terms for future orders; the terms in force when you order apply to that order. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that consumers resident elsewhere in the UK may rely on the courts and mandatory consumer protections of their home nation.
